The Legal Assistance Agreement in Criminal Matters signed between Turkey and Croatia was approved by being published in the Official Gazette dated 02.06.2021 and numbered 31499.
With this Agreement, the parties will provide each other with the widest scope of legal assistance in criminal matters.
Legal assistance in criminal matters includes the service of documents, the search, and seizure of evidence and documents, crime scene investigation, expert examination, questioning of the suspect or the accused, the transmission of evidence, criminal record and documents, and assistance to the extent permitted by the laws of the requested country. However, according to the Agreement, it can be decided to search and seize evidence and to confiscate the proceeds of crime in crimes that are subject to punishment according to the laws of both parties.
It is stated that the request for legal aid will be refused in case of a political crime or a crime related to a political crime or in cases where the sovereignty, security and public order of the state would be endangered.
This Agreement is signed for an indefinite period and it can be terminated at any time by written notice of the parties.
