Public Procurement Authority Updates Cost Analyses and Tender Procedures for Construction Works

On July 30, 2025, the "Communiqué Amending the Public Procurement Communiqué" was published in Issue No. 32971 of the Official Gazette, introducing significant amendments related to construction work analyses and tender procedures. 1. Update in Cost Analyses
With the amendments to Articles 52.2 and 53.5 of the Communiqué, the phrase "official analysis" has been supplemented with the expression "d in accordance with the third paragraph of Article 22 of the General Specifications for Construction Works." This change makes it mandatory to construction cost analyses according to specific principles.
2. New Provision for Contract Terms
An amendment to Article 53.5 introduces a specific rule for cases where the profit and general expense rates have not been predetermined in the contract. This ensures a more transparent and up-to-date method in unit price calculations.
3. Transitional Provision
According to the newly added Provisional Article 22, tenders announced or published before September 1, 2025, will be concluded under the provisions of the Communiqué in effect at the date of announcement or publication. This regulation aims to prevent legal uncertainties in ongoing tenders.
4. Effective Date
The Communiqué will enter into force on September 1, 2025, and will be implemented by the President of the Public Procurement Authority.
