PRESIDENTIAL DECREE ON THE SUPPORT OF CRIME VICTIMS

With the ''presidential decree on the Support of Crime Victims'' number 63, published in the Official Gazette dated June 10, 2020 and numbered 31151, principles and duties, powers and responsibilities regarding the services and assistance provided to crime victims have been regulated.The decree covers the investigation and prosecution of crime victimization that carried out in Turkey.

The decree includes that regarding the rights and supports provided to the victim upon request, the law enforcement units and the judicial support and victim services departments established within the courthouse; as well as informing and directing the victim, it includes that taking measures by law enforcement units to protect the victim and family members and to prevent repetition of the crime.

willful murder and attempt to commit this crime, aggravated injury, sexual abuse of children, sexual assault in the second degree and aggravated torture; to those who are the victims of these crimes will be provided services which includes taking measures to prevent contact of the victim with the suspect or the accused, taking protective and preventive measures by the law enforcement unit where the victim is located in cases of evacuation or desertion, giving information to the victim in case of danger, giving them priority to participation in vocational courses organized by municipalities and non-governmental organizations and public institutions and organizations, to benefit primarily from the economic and social supports of public institutions and organizations and municipalities.In addition, upon the requests of the crime victims, it can be ensured for themself or their family members, if they work in a public institution or organization, to change the place of employment; if they work in the private sector, he / she can work in another workplace belonging to the same employer.The same priority is given to the change of institutions where  themselves or their dependents or descendant is trained.guidance services can also be provided to Victim in this new education institution.

Under the heading of services to be provided to fragile groups; It is stated that if the children included in the judicial system and those who are victims of crimes against sexual integrity or domestic violence, terrorism and human trafficking, apply to benefit from the services in the regulation, they will be evaluated by the judicial support officers working within the directorate.Depending on the nature of the victim and the crime, other victims who are more affected by the crime and need to be protected can also benefit from these services.

Services for related persons in the Decree are as follows are explaining the environment, related persons and process in order to reduce the level of anxiety before the victim is questioned, taking the necessary measures for the victim to express themself comfortably and presence of the judicial support officer while the victim is questioned, prepearing a social review report, proposing that to take the statements in the judicial interview room, directing victims who need treatment and rehabilitation and to implement case management in services for victims who are considered in need of effective support.Victims whose support needs continue after the investigation or prosecution process is completed are directed to the relevant institutions.Necessary measures are taken by the administrative authority for the victims whose protective and supportive measures are not taken.If it is necessary, these services can also be provided to those who affected by crime.

According to the Presidential Decree; judicial interview rooms are established within the directorate in order to take the statements of the victims of crime through the judicial support offical in a private environment. Also; in order to prevent the repeated victimization of sexual crime victims and to ensure that judicial and medical procedures are carried out by trained officials at once, centers providing services for victims of sexual crime are established.These centers can also be established by universities.

Municipalities, universities and other public institutions and organizations in order to contribute to victim services; It can develop joint programs with the Ministry, as well as allocate space and can make or have the construction, maintenance and repair of service buildings and meet all kinds of tools and materials needs.In addition, volunteers can also be used in assistance and support services for victims. Cooperation can be made with universities, bar associations and related institutions and organizations regarding victim rights and approach to victim.
