In the Official Gazette No. 31410 dated March 1, 2020, the Communiqué on Amending the Communiqué Regarding the Procedures and Principles Regarding Fees That Can Be Taken From Commercial Customers By Banks No. 2020/4 was published.
In the Communiqué numbered 2020/4, which was created in order to ensure that the transactions of banks with commercial customers are predictable and transparent, to create common terms and concepts, and to prevent excessive pricing, T.C. The Central Bank has made some changes. Transactions regarding loan allocation and loan disbursement are evaluated separately by the banks, so their fees are also calculated separately. It is determined in the Communiqué No. 2020/4 that the loan allocation fee cannot exceed twenty-five per ten thousand of the credit limit allocated, and the loan disbursement fee cannot exceed one percent of the loan being granted. With the aforementioned amendment, it was determined that the loan disbursement fee cannot exceed "%1.10" of the loan granted. A clause was added to article 11 of the Communiqué numbered 2020/4, which includes regulations on closing commercial credit debt. In the aforementioned paragraph; It has been regulated that if the commercial customer requests early payment for the entire loan in loans granted as of 1/3/2021, the bank has to accept this request. An early payment fee of up to two percent of the amount calculated by making discounts on the interest and other cost elements required for Turkish lira loans and the amount paid early by the customer to the bank, whose remaining maturity does not exceed twenty-four months, may be charged from the customer. For loans with a remaining maturity of more than twenty-four months, an early payment fee up to the amount calculated by adding one percent for each year for the part exceeding two percent of the remaining maturity of more than twenty-four months can be charged. In the paragraph, it has been announced that the remaining periods of the remaining term in the calculation will be completed to the year, and for foreign currency denominated or foreign currency indexed loans, the maximum fee to be applied for Turkish lira loans can be applied with one point increase. It was stated that the Communiqué containing the above-mentioned changes will enter into force as of March 1, 2021, the date of publication.
