The notification obligation in the energy market is regulated by the Energy Market Notification Regulation. The energy market includes the electricity, natural gas, oil and LPG markets.
The purpose of this Regulation is to regulate the principles, procedures and principles regarding the collection of data required by EMRA in the process of monitoring, analyzing and reporting market activities in the energy market in order to achieve the objectives specified in the relevant legislation.
Notification agent is the real or legal person who is obliged to send the information and documents requested by EMRA.
Notification agents are obliged to determine the notification officers. In order to ensure that these authorities can make a notification, the application petition and the notification obligation authorities must submit a written statement to EMRA stating that they are authorized to make a notification electronically.
Notifications are made with electronic signature by the officials of the notification obligation, unless otherwise specified. If needed, the wet signed versions of these notifications may also be requested by EMRA.
If the last day of the notification period coincides with a public holiday, the notification period is extended until the end of the first business day following the holiday.
The notification obligation covers the notification periods during the license is in effect. In the period when the notification obligation is required to make a notification, the failure of its business to operate does not terminate the notification obligation. In this case, it must indicate that the company subject to notification did not operate in the said period. In case the license of the notification obligee expires or is canceled, the notifications to be made with an electronic signature regarding the activities carried out before the expiry date of this license or before the cancellation are made in writing.
The notification obligation table prepared by EMRA is published in the Official Gazette. EMRA is obliged to keep the information and documents submitted to it by the notification officer confidential, except for the authorities authorized by legislation and the reports to be submitted to the public or concerned parties. However, it can explain with the consent of the notification agents.
