EMRA has issued a Regulation to regulate the procedures and principles regarding the modification of the existing contracts of legal entities who are given the task of continuing electricity generation, transmission, distribution and trade within the scope of their existing contracts, and the transfer of transmission activities and renounced activities.
Legal entities that maintain or are expected to continue more than one market activities together within the scope of their existing contracts are obliged to notify the Ministry of Energy and Natural Resources and EMRA of their request to withdraw from the production and/or distribution activity within 10 working days following the notification made by EMRA in the concession agreements regarding assignment. If the waiver notification is not made within the time limit, it is accepted that the said legal entities want to continue their production and distribution activities together. Production and / or distribution license applications of these legal entities are not considered unless the changes notified by EMRA are fulfilled.
In the event that persons who are or are expected to continue electricity generation and distribution activities together request to give up one of these activities, the transfer of the generation and / or distribution facilities where the abandoned activity continues, must happen within 6 months at the latest following the notification of the cancellation request to the Ministry of Energy and Natural Resources and EMRA.
